Fire Safety Rules Affecting all Non-Domestic Premises in England and Wales came into force on 1st October 2006.

The Regulatory Reform (Fire Safety) order 2005 or "the Fire Order" States companies are required to complete a Fire Risk Assessment and have a documented emergency plan.

In a workplace the responsible person is the employer, who has a duty to take such general fire precautions as will ensure, so far as is reasonably practicable, the safety of employees and others. The new legislation also includes a requirement to reduce the level of present risk.

Each offence for non compliance is punishable by a fine or a two year prison term.

However it is in our opinion that if a fire were to occur and it was shown that the employer had failed in his duty to ensure an employee's safety leading to injury or death, the legal ramifications (criminal and civil) could be far reaching.
